A contractual relationship has not (yet) been formed as a result. Despite the best efforts of Volkshilfe Oberösterreich, no liability can be accepted for ensuring that information is accurate, complete and up to date. As the information is always judged dependent on the specific facts and circumstances, the information offered by Volkshilfe Oberösterreich can also only serve as a guide and does not replace a personal consultation. Consent to communication by email is considered as normal given the information available online and consent is deemed given despite the associated risks.

No claims can be derived from this against Volkshilfe Oberösterreich and similarly there is no entitlement to publication or online provision if the data, text, information or contributions are forwarded to Volkshilfe Oberösterreich.

Liability

Liability claims against Volkshilfe Oberösterreich which relate to direct or indirect damage of a material or immaterial nature caused by use or non-use of information reproduced or by incorrect, incomplete or out-of-date information are generally excluded unless Volkshilfe Oberösterreich is proven to have committed intent or gross negligence. No liability is accepted for transmission mistakes or other errors in transmission. The transmission is not initiated by Volkshilfe Oberösterreich and there are no possibilities of influencing the communication network, modes of transmission and transmission speed. Volkshilfe Oberösterreich can assume no liability for faults, power failures, improper operation, computer virus attacks or the technical framework. In the case of a consumer transaction, statutory requirements shall apply vis-à-vis consumers, compensation for any harm to persons is neither excluded nor restricted, and compensation for other damage is excluded only in the event that Volkshilfe Oberösterreich or a person for whom Volkshilfe Oberösterreich is responsible has caused the damage through slight negligence. At its discretion, Volkshilfe Oberösterreich expressly reserves the right to amend, add to, delete, temporarily cease publication or provision online of or block access to parts of the information or all the information on offer. Advance notice is not required in this case. No claims can be derived from this against Volkshilfe Oberösterreich.

Copyright and data protection

Even a partial reproduction, distribution, publication, broadcasting, provision or other use of the information offered by Volkshilfe Oberösterreich is not permitted without prior approval from this organisation. If Volkshilfe Oberösterreich is sent data, text, information or contributions, Volkshilfe Oberösterreich is entitled to the corresponding rights and power of disposal, unlimited in time and space, for the purpose of providing online, storing, reproducing, disclosing publically, sending, otherwise distributing, and processing said text, information and contributions. Volkshilfe Oberösterreich is exclusively entitled to rights and the power of disposal, unlimited in terms of content, time and space, concerning own data, text, information and contributions as well as all software, photographs, graphics, audible signals and the entire portal. As far as (personal) data is entered or disclosed, this data is provided with the express consent of the individual user and entitled party.
Volkshilfe Oberösterreich is therefore entitled to send using computer assistance, collect, store, further process and send this data. The application and use of such data by third parties is not permitted.

General

The provisions in this liability disclaimer shall apply to all information and services of Volkshilfe Oberösterreich even if no specific reference is made to them. Should individual parts of this liability disclaimer not or no longer correspond to the respective applicable legislation, the liability disclaimer shall otherwise remain unaffected. The ineffective or invalid provision must be replaced by a provision which most closely reflects the economic purpose intended. Austrian substantive law (Sachrecht) is agreed to apply to any legal disputes, and – with the exception of consumer transactions – the respective court in Upper Austria competent in substantive law is agreed as the court of jurisdiction for said disputes.
